Product liability in Texas is primarily governed by Chapter 82 of the Texas Civil Practice and Remedies Code. Texas law recognizes three types of defects: design defects, manufacturing defects, and marketing defects (failure to warn). Under Section 16.003, plaintiffs generally have a two-year statute of limitations from the date of injury to file a claim. Crucially, Texas also enforces a 15-year statute of repose (Section 16.012), which generally bars lawsuits for injuries caused by products that were first sold more than 15 years ago, regardless of when the injury occurred.
