Sexual harassment in Texas workplaces is prohibited under both federal law and the Texas Labor Code, and a 2021 legislative change expanded state-level protections to cover employees at companies with as few as one employee. Workers who experience unwelcome sexual conduct, quid pro quo demands, or a hostile work environment based on sex have the right to file a complaint and, in appropriate circumstances, pursue a lawsuit against their employer.

Sexual harassment in Texas workplaces is prohibited under Texas Labor Code Chapter 21, which implements the Texas Commission on Human Rights Act. House Bill 21, passed by the Texas Legislature in 2021, expanded the definition of employer under the sexual harassment provisions of Chapter 21 to include any person who employs one or more employees, significantly broadening the scope of covered employers beyond the previous threshold. An employer commits an unlawful employment practice when sexual harassment occurs and the employer or its agents knew or should have known about the conduct and failed to take immediate and appropriate corrective action. Employees who wish to file a sexual harassment charge must do so with the Texas Workforce Commission Civil Rights Division within 180 days of the alleged harassment, or within 300 days if filing concurrently with the EEOC under the work-sharing agreement between those agencies. After an administrative charge is resolved, an employee who receives a right-to-sue notice may pursue a civil lawsuit in court. An employment attorney can help evaluate the evidence, meet applicable deadlines, and navigate the procedural requirements before any lawsuit is filed.
